This Acceptable Use Policy (the “Policy”) applies to On Air Telecom LLC and all its affiliated entities (collectively, “On Air Telecom”, “we”, “our”, or “us”). This Policy outlines prohibited activities and acceptable use of services provided by On Air Telecom (the “Services”) and applies to all customers and users (collectively, “Users”) who access or use the Services directly or indirectly.
All capitalized terms not defined herein shall have the meaning ascribed to them in the service agreement(s) between Customer and On Air Telecom (“Agreement”).
1. Purpose
The purpose of this Policy is to ensure the responsible, lawful, and secure use of On Air Telecom’s network and Services. This Policy is designed to protect our network, our customers, other users of the Internet, and the broader online community from improper or illegal activities. Any use of our Services that violates this Policy is strictly prohibited.
2. Prohibited Activities
Any use of the Services that violates this Policy, as determined solely by On Air Telecom, constitutes a breach of the Agreement and may result in suspension or termination of Services. Customers must ensure all Users comply with this Policy and immediately notify On Air Telecom of any actual or suspected violations.
2.1 Illegal Use
Use of the Services in violation of any applicable law or regulation is prohibited. This includes, but is not limited to:
Telecom & Privacy Laws: Violations of the Telephone Consumer Protection Act (TCPA), spoofing laws, slamming, and similar regulations.
Intellectual Property: Unauthorized transmission or distribution of material protected by copyright, trademark, trade secret, or other proprietary rights.
Obscene or Harmful Content: Transmission of child pornography, hate speech, threats, libel, or defamatory content.
Export Control: Unauthorized export of technology or data subject to U.S. export control laws.
CAN-SPAM Act: Failure to comply with all provisions of the CAN-SPAM Act (15 U.S.C. 7701 et seq.).
2.2 Network & System Security
Users may not attempt to compromise the security or integrity of On Air Telecom’s systems or any third-party network, including:
Unauthorized access or use of networks, systems, or data (hacking).
Unauthorized scanning, monitoring, or sniffing of network traffic.
Distribution of viruses, malware, Trojan horses, or other harmful software.
Interference with service to any user, host, or network (e.g., denial-of-service attacks).
Spoofing or forging of any header or IP packet information.
2.3 Email & Messaging Abuse
The following activities are strictly prohibited:
Unsolicited Email (SPAM): Sending bulk email without verified, opt-in consent.
Email Relay Abuse: Using unauthorized mail servers to send messages.
Newsgroup/Forum Misuse: Off-topic, repetitive, or abusive postings.
IP Reputation Damage: Allowing any IP address under your use to be blacklisted or flagged due to abuse.
2.4 Complaint Handling
Customers must respond to any abuse or misuse complaint within 24 hours of notice. Failure to respond or excessive complaints (more than 3 per month or 10 per 90 days) may result in account suspension or termination. On Air Telecom may request transmission records and consent documentation as part of an investigation.
3. Enforcement and Remedies
In the event of a violation, On Air Telecom may take one or more of the following actions at its sole discretion:
Warning: Issuance of a formal notice requiring corrective action.
Service Suspension: Temporary suspension of Services, with or without prior notice.
Service Termination: Termination of the Customer’s Services or Agreement.
On Air Telecom reserves the right to take any other action it deems appropriate, and such enforcement shall not limit its rights under any Agreement.
4. Miscellaneous
No Waiver: Failure to enforce any part of this Policy does not waive On Air Telecom’s rights.
Monitoring: On Air Telecom does not routinely monitor content but reserves the right to do so when it reasonably suspects a violation.
Law Enforcement Cooperation: We cooperate with law enforcement and regulatory agencies as necessary.
Policy Modifications: We may amend this Policy at any time by posting the updated version at www.onairtel.com. Continued use of the Services after such updates constitutes acceptance.
